Refund & Return Policty

Refund and Cancellation Policy

Linkly LLC Last updated: [14 September 2026] Effective date: [14 September 2026]

This policy explains when charges can be cancelled or refunded, what is non-refundable, and how to request a refund. It forms part of our Terms of Service.

1. What this policy covers

We sell transportation and customs services, not goods. There is nothing to return, so this policy deals with cancellations, refunds, and billing corrections rather than product returns.

Three things are handled elsewhere and are not refunds:

  • Loss or damage to cargo — governed by Section 10 of our Terms of Service, under the claim deadlines and liability limits set out there.
  • Insured cargo losses — handled by the cargo insurer under the policy you purchased.
  • Duty and tax overpayments — recovered from U.S. Customs and Border Protection, not from us. See Section 7.

2. Cancelling a booking

Cancellation charges depend on how far the shipment has progressed. All cancellations must be sent in writing to [operations@linkly.com].

When you cancelWhat you pay
Before cargo pickup or warehouse receiptNo charge. Any prepayment is refunded in full
After pickup, before loadingActual costs incurred — pickup, drayage, handling, storage — plus [$75] administration
After loading, before departureActual costs incurred, plus carrier cancellation or rollover charges, plus [$150] administration
After departureNo refund. The shipment must be completed, returned, or abandoned, and all charges apply

“Actual costs incurred” means amounts we have already paid or become liable to pay to carriers, terminals, warehouses, and agents. We will itemize them.

Space cancellation by carriers. Ocean and air carriers apply their own no-show, cancellation, and rollover fees. Where a carrier charges us, that charge passes through to you at cost.

3. Cancellation by us

We may cancel a booking where:

  • the cargo is misdescribed, prohibited, or undeclared;
  • documents or instructions are not provided by the cut-off;
  • a sanctions or denied-party screening fails;
  • payment terms are not met;
  • a government authority refuses the shipment.

Where we cancel for any of these reasons, charges already incurred remain payable and prepayments are refunded net of those charges.

Where we cancel for our own operational reasons and none of the above applies, you receive a full refund of everything paid for that shipment.

4. Deposits and prepayments

Deposits are applied to the final invoice, not held separately. Where a shipment is cancelled, the deposit is refunded less any costs incurred under Section 2.

Prepaid freight on a shipment that never moves is refunded in full within [10] business days.

5. Refunds for service failure

We will refund or credit our own service charges where we failed to perform something we agreed in writing to do — for example, a booking we failed to place, a filing we failed to make on time, or a service you were billed for but did not receive.

This refund covers our fees, not third-party costs and not the value of your cargo. Consequential losses are excluded under Section 9.3 of our Terms of Service.

Transit times are estimates, not guarantees. A shipment arriving later than the quoted window is not, by itself, grounds for a refund. Where we have agreed a guaranteed service in writing and charged a premium for it, the premium is refundable if the guarantee is missed.

6. Billing errors and overcharges

Check your invoice. If something looks wrong, tell us within [30] days of the invoice date and we will investigate.

We correct without argument where:

  • a charge was duplicated;
  • a rate was applied that differs from the written quotation, and the shipment matched what was quoted;
  • a service was billed but not performed;
  • a weight, dimension, or classification was entered incorrectly on our side.

Corrections are issued as a credit note against your account, or refunded to the original payment method if you have no open balance.

Re-weighs and re-measures are not billing errors. Where a carrier reweighs or remeasures a shipment and it differs from what you declared, the resulting charge is valid and is not refundable. We will supply the carrier’s certificate on request.

Disputing one line item does not suspend payment of the rest of the invoice.

7. Duties, taxes, and government charges

Duties, tariffs, and taxes are collected by the government, not by us. We advance them on your behalf and invoice them at cost.

Where an overpayment occurs, the refund must be recovered from CBP through a post-summary correction, protest, or duty drawback claim. We can prepare and file these [for a fee], but the timeline is set by CBP and is typically [several months]. We cannot refund duty we have already remitted.

8. Non-refundable charges

The following are not refundable once incurred:

  • customs entry preparation and filing fees, once the entry or ISF has been transmitted;
  • cargo insurance premiums, once cover has attached;
  • bill of lading, air waybill, and documentation fees, once issued;
  • demurrage, detention, per-diem, and storage;
  • inspection, examination, and X-ray charges imposed by a government agency;
  • fumigation, palletizing, repacking, and any physical work already performed;
  • bank charges, wire fees, and currency conversion losses;
  • charges arising from information you supplied that turned out to be inaccurate.

9. Refused, undeliverable, and abandoned shipments

Where a consignee refuses delivery or the shipment cannot be delivered:

  • original freight charges are not refundable;
  • return, re-delivery, storage, and disposal charges are payable by you;
  • we will hold the goods and seek instructions for [30] days.

Goods uncollected after [90] days may be treated as abandoned and disposed of under Section 13 of our Terms of Service, with disposal costs charged to you.

10. How to request a refund

Send the following to [billing@linkly.com] with the subject line “Refund Request”:

  1. Invoice number and booking or container number
  2. The specific charge or charges in question
  3. The amount claimed
  4. What you believe went wrong, and any supporting documents

Deadline: within [30] days of the invoice date. Requests received later cannot be processed, as our own recovery windows with carriers will have closed.

Our response: acknowledgement within [2] business days, and a decision within [15] business days. Where a carrier or government agency must be involved, we will tell you and give you a revised timeline.

11. How refunds are paid

Approved refunds are issued to the original payment method where possible, otherwise by [ACH or check] to the account on file.

  • Credit card: [5–10] business days, depending on your issuer
  • ACH or wire: [5] business days
  • Account credit: applied immediately to your next invoice

We do not refund to a third party or to an account other than the one that paid.

12. Chargebacks

If you dispute a charge with your bank or card issuer before raising it with us, we may suspend services and exercise our lien under Section 12 of our Terms of Service until the dispute is resolved.

Talk to us first. Almost every billing dispute is settled faster directly than through a chargeback.

13. Changes to this policy

We may update this policy. The version in effect when your shipment is booked applies to that shipment.
